  • Subject to the provisions of Sections 43(5) and 43 (6) of the ECT Act, if applicable, and as far as allowed by law, Swiftnet (including its owners, employees, suppliers, Internet service providers, partners, affiliates and agents) shall not be liable for any damage, loss or liability of any nature incurred by whomever and resulting from:

    1. Access to the FastNet web site
    2. Access to web sites linked to the FastNet web site
    3. Inability to access the FastNet web site
    4. Inability to access web sites linked to the FastNet web site
    5. Content available on the FastNet web site
    6. Services available from the FastNet web site
    7. Products available from the FastNet web site
    8. Downloads and use of content from the FastNet web site; and/or
    9. Any other reason not directly related to Swiftnet’s gross negligence

  • FastNet website is supplied on an “as is” basis and has not been compiled to meet the User’s individual requirements. It is the responsibility of the user to satisfy himself or herself, prior to entering into this agreement with Swiftnet, that the content available from and through the FastNet web site meets the user’s individual requirements and is compatible with the user’s hardware and/or software.

  • Information, ideas and opinions expressed on the FastNet web site should not be regarded as professional advice or the official opinion of Swiftnet and users are encouraged to seek professional advice before taking any course of action related to the information, ideas and opinions expressed on the FastNet web site.

  • Swiftnet does not make any warranties or representation that content or services available from the FastNet web site shall in all cases be true, correct or free from any errors. Swiftnet shall take all reasonable steps to ensure the quality and accuracy of content available from the FastNet web site.

  • Swiftnet does not make any warranties or representation that the FastNet web site shall be available at all times. Users acknowledge that the FastNet web site may be unavailable due to updates or other causes beyond the reasonable control of Swiftnet, including but not limited to virus infection, unauthorized access (hacking), power failure, or other “acts of God”.
 

Intellectual Property Rights


  • The intellectual property rights including (without limitation) copyrights and the trade and service marks utilized by Swiftnet, shall remain the property of Swiftnet or Swiftnet’s licensers and, save as provided herein, nothing contained in the Agreement shall be construed to confer on the customer any rights or licenses in such intellectual property rights.

  • Should Swiftnet be required to develop any computer code, data, documents, presentations, solutions design, web site or any application ("the work"), then all intellectual property rights in and to such work shall vest exclusively in Swiftnet. To the extent that intellectual property rights in the work vests, for whatever reason, in the customer, the customer hereby agrees to assign all such intellectual property rights to Swiftnet, which hereby accepts such assignment.

  • Save as provided for in this agreement, any license granted to the customer in terms of the agreement shall be for singular user only. The customer shall be obliged to pay a license fee for multiple uses.

  • The customer shall not modify or use any software, computer code, data, documents, presentations, solutions design, web site or any application licensed to it in terms of the agreement, to create a derivative work.
